🏛️ Terms and Conditions of Service – Zagtme Private Limited

1. Introduction and Acceptance

• These Terms and Conditions of Service ("Terms") govern your use of the Zagtme website (www.zagtme.com) and the Zagtme mobile application (collectively, the "Platform") operated by Zagtme Private Limited ("Zagtme," "we," "us," or "our").
• By accessing, downloading, or using the Platform, you agree to be bound by these Terms and all incorporated policies, including the Privacy Policy, Refund & Cancellation Policy, and Shipping & Delivery Policy. If you do not agree to these Terms, you may not use the Platform.

2. Eligibility and Account Responsibility

• Eligibility: Use of the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. You must be 18 years of age or older to use the app or place orders, or must use the Platform under the direct supervision of a parent or legal guardian.
• Account Security: You are solely responsible for maintaining the confidentiality of your login credentials (password, OTP) and for all activities that occur under your account. You must notify Zagtme immediately of any unauthorized use.

3. Orders, Pricing, and Payments

• Order Acceptance: All orders placed are subject to acceptance and availability by the respective vendor/merchant. Zagtme reserves the right to refuse or cancel any order at its sole discretion.
• Pricing: All prices listed are inclusive of applicable Goods and Services Tax (GST) or other taxes unless explicitly stated otherwise. Pricing is subject to change without prior notice, but the price confirmed at checkout will apply to that transaction.
• Payment Gateway: Payments are processed securely via third-party payment gateways, including Razorpay. By making a payment, you warrant that you are legally authorized to use the payment method provided. Zagtme is not responsible for any failures, errors, or delays caused by the payment gateway.

4. Shipping, Delivery, and Returns

• Service Area: Delivery is available only in the specific cities/areas where Zagtme operates, as outlined in the Shipping & Delivery Policy.
• Delivery Estimates: Delivery times are estimates and may vary based on product type, vendor availability, and logistics. Zagtme is not liable for indirect losses caused by delivery delays beyond reasonable control.
• Cancellation & Refunds: Orders can be cancelled before dispatch. Refunds for cancellations or failed payments are subject to the terms and processing times specified in our detailed Refund & Cancellation Policy.
• Returns & Replacements: Returns are accepted only for damaged, defective, or wrong items, as detailed in the Return & Replacement Policy. Requests must be made within 24 hours of delivery.

5. Vendor/Partner Obligations

• Vendors listing products on the Platform must adhere to the Vendor/Partner Policy, which requires them to:
  • Deliver authentic and quality products.
  • Comply with all packaging, safety, hygiene, and applicable legal/tax regulations.
• Zagtme acts purely as a facilitator and intermediary. While we ensure vendor verification, we are not liable for product defects beyond vendor-provided warranties. Zagtme reserves the right to suspend or terminate vendors who fail to meet quality standards.

6. User Conduct and Prohibited Activities

• You agree to comply with the User Conduct Policy. Prohibited activities include:
  • Placing fraudulent orders or misusing promotional offers.
  • Using abusive, unlawful, or harmful language towards any Zagtme staff, vendors, or delivery partners.
  • Any unlawful, harmful, or fraudulent activities on the Platform.
• Violations may lead to the immediate suspension or permanent ban of your account.

7. Intellectual Property and Content

• All content, trademarks, logos, and technology on the Platform are the property of Zagtme Private Limited or its licensors and are protected by applicable intellectual property laws. You may not use, copy, or distribute any content without our prior written consent.
• Cookie Policy: We use cookies and similar technologies to enhance performance and analyze traffic, as detailed in our Cookie Policy. Users can manage these settings in their browser/app.

8. Disclaimer and Limitation of Liability

• Disclaimer: The Platform and all services are provided on an "as is" and "as available" basis. Zagtme makes no warranties, express or implied, regarding the operation, availability, or content of the Platform.
• Limitation of Liability: To the maximum extent permitted by law, Zagtme Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Platform or the products purchased. Our total liability to you shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

9. Governing Law and Jurisdiction

• These Terms shall be governed by the laws of India.
• All disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in [Insert Your City, e.g., Bangalore].

10. Future Expansion Clause
